Foi publicada em edição extra do Diário Oficial da União de hoje, 29 de abril de 2020, a Medida Provisória no. 959 (“MP 959”) que, além de tratar de questões relacionadas ao pagamento do Benefício Emergencial aprovado pelo Governo anteriormente, alterou o prazo de vigência da Lei 13.709, de 14 de agosto de 2018, a Lei Geral de Proteção de Dados (“LGPD”).
De acordo com a MP 959, a LGPD – exceto pelos dispositivos que tratam da Autoridade Nacional de Proteção de Dados (ANPD) e do Conselho Nacional de Proteção de Dados Pessoais e da Privacidade – entrará em vigor em 3 de maio de 2021.
Com essa medida, o Governo atropela o Projeto de Lei 1.179/2020 de iniciativa do Senado Federal, já aprovado naquela Casa, e que aguarda tramitação na Câmara dos Deputados.
De acordo com o PL 1.179/2020, que dispõe sobre o Regime Jurídico Emergencial e Transitório das relações jurídicas de Direito Privado (RJET) no período da pandemia do coronavírus (Covid- 19), a proposta é um escalonamento da vigência da LGPD, de modo que a lei entre em vigor em janeiro de 2021, e a aplicação das penalidades passe a ser válida apenas a partir de agosto de 2021.
Assim, durante a vigência da MP 959 – inicialmente de 60 dias, prorrogáveis por mais 60, fica postergada a vigência da LGPD para 3 de maio de 2021.
It was published in an extra edition of the Federal Official Gazette of today, April 29, 2020, Provisional Measure no. 959 (“MP 959”) which, besides dealing with issues related to the payment of the Emergency Benefit previously approved by the Government, changed the term of effectiveness of Law 13,709, of August 14, 2018, the Brazilian General Data Protection Law (“LGPD”).
According to MP 959, the LGPD – except for the provisions dealing with the National Data Protection Authority (ANPD) and the National Council for Personal Data Protection and Privacy – will come into force on May 3, 2021.
With this measure, the Government is running over Bill 1,179/2020, an initiative of the Federal Senate, which has already been approved in that House and is awaiting processing in the House of Representatives.
According to PL 1.179/2020, which provides for the Emergency and Transitional Legal Regime of Private Law Relations (RJET) during the Coronavirus pandemic (Covid- 19), the proposal is for the LGPD to come into force in January 2021 and penalties to be applied only from August 2021.
Thus, during the term of MP 959 – initially 60 days, extendable for a further 60 days, the LGPD is postponed to May 3, 2021.
